(A) Rizer Pty Limited (ACN 113 780 082) and its related body corporate in Singapore, (UEN 201934061D) (together, “we”, “us”, “our” or “Rizer”), are committed to protecting your privacy and to handling your personal information in an open and transparent way. This Privacy Policy explains how we collect, hold, use, store, disclose and otherwise handle your personal information, and how you can access and correct it or make a complaint.

(B) This Privacy Policy applies to our website, products and services, and to any dealings you have with us. By accessing or using our website, products and services, or by otherwise providing your personal information to us, you agree to the collection, use, storage and disclosure of your personal information in accordance with this Privacy Policy.

1. Who we are and the laws that apply

(a) Rizer Pty Limited handles personal information in accordance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). For individuals in Singapore, our Singapore entity also handles personal data in accordance with the Singapore Personal Data Protection Act 2012 (PDPA). Section 18 of this Privacy Policy sets out additional information that applies to individuals in Singapore.

(b) We take reasonable steps to comply with our obligations under these laws and to deal with any inquiries or complaints from individuals about our handling of their personal information.

2. What is personal information

(a) Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether or not it is recorded in a material form.

(b) Some personal information we collect is sensitive information - for example, information about your health, or a copy of a government-issued identity document. We will only collect sensitive information where it is reasonably necessary for our functions or activities and either you have consented, or we are otherwise permitted or required to do so by law.

3. The personal information we collect

The kinds of personal information we collect and hold depend on your dealings with us. They may include:

Any Other Information	Any other personal information you choose to provide, or that is reasonably necessary to facilitate your dealings with us.

4. How we collect your personal information

(a) We collect personal information only by lawful and fair means and not in an unreasonably intrusive way. Wherever practicable, we collect personal information directly from you - for example when you:

(i) complete a form or make an enquiry through our website;

(ii) communicate with us by email, telephone, in person or through social media;

(iii) engage us for, or participate in, our services, productions or events;

(iv) provide us with feedback or complete a survey; or

(v) otherwise interact with our website or online presence.

(b) We may also collect personal information about you from third parties, such as our business partners, service providers, agents, referees, or publicly available sources, where it is not reasonable or practicable to collect it directly from you.

5. Cookies, analytics and tracking technologies

(a) When you visit our website, we and our service providers may use cookies and similar tracking technologies to help operate the website, analyse how it is used, remember your preferences and, where permitted, deliver and measure advertising. Cookies are small files stored on your device that allow a website to recognise your device across pages, sessions and, in some cases, other websites.

(b) You can disable or delete cookies through your browser settings. If you do, some features of our website may not function properly. Our website may also contain links to third-party websites; we are not responsible for the privacy practices of those websites and encourage you to review their privacy policies.

6. Why we collect, hold, use and disclose your personal information

We collect, hold, use and disclose your personal information for the purposes for which it was collected, for related purposes you would reasonably expect, and where we are otherwise permitted or required by law. These purposes include:

(a) providing our website, products and services to you;

(b) administering, protecting, improving and optimising our website and services, including data analytics, research and internal record-keeping;

(d) communicating with you and responding to your enquiries, requests, feedback and complaints;

(e) verifying your identity;

(f) informing you about our products, services, events, promotions and other activities that we consider may be of interest to you (see section 8);

(g) complying with our legal and regulatory obligations; and

(h) any other purpose you have consented to.

7. Disclosure of your personal information

(a) We may disclose your personal information to:

(i) our related entities and personnel, on a need-to-know basis, for the purposes described in this Privacy Policy;

(ii) third-party service providers and contractors we engage to perform functions on our behalf, such as IT, hosting, payment, marketing, analytics and professional service providers;

(iii) our external professional advisers, including auditors, lawyers, insurers and financiers;

(iv) any person or entity to whom you have consented to us disclosing your personal information; and

(v) any person or entity where we are required or authorised to do so by law.

(b) We take reasonable steps to ensure that third parties who handle personal information on our behalf are bound by appropriate confidentiality and privacy obligations.

8. Direct marketing

(a) Where we have your consent, or where we are otherwise permitted by law, we may use your personal information to send you marketing communications about events, products and services we believe may be of interest to you.

(b) You may opt out of receiving direct marketing communications from us at any time by using the unsubscribe facility in the relevant communication, or by contacting us in writing at office@rizer.com.au. Unless you opt out, your consent to receive direct marketing communications from us will continue.

9. Overseas disclosure

(a) Some of the third parties to whom we disclose your personal information, including our related entity and service providers, may be located outside Australia - including in Singapore and in other countries where our service providers operate. The countries in which recipients are located will vary from time to time, but are likely to include Singapore and the United States.

(b) Before disclosing personal information overseas, we take steps that are reasonable in the circumstances to ensure that the overseas recipient handles your personal information in a manner consistent with the APPs, having regard to the nature of the disclosure and the recipient. By providing your personal information to us, you acknowledge and consent to these overseas disclosures.

10. How we hold and protect your personal information

(a) We may hold your personal information in electronic or hard-copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, using a range of physical, administrative, personnel and technical measures.

(b) No method of transmission over the internet, or method of electronic storage, is completely secure. While we take reasonable steps to protect your personal information, we cannot guarantee its absolute security, and any transmission of information to us is at your own risk.

11. How long we keep your personal information

We keep your personal information only for as long as it is reasonably necessary for the purposes for which it was collected, or as required to comply with our legal, regulatory, accounting or reporting obligations. When personal information is no longer required, we take reasonable steps to destroy it or to permanently de-identify it.

12. Data breaches

If we become aware of a data breach that is likely to result in serious harm to any individual whose personal information is involved, we will respond in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act, including by notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required. Our handling of data breaches affecting individuals in Singapore is described in section 18.

13. Automated decision-making

We do not currently use your personal information to make decisions about you solely by automated means where those decisions could reasonably be expected to significantly affect your rights or interests. If this changes, we will update this Privacy Policy accordingly.

14. Anonymity and pseudonymity

Where it is lawful and practicable to do so, you may deal with us anonymously or by using a pseudonym. However, if you do not provide us with the personal information we reasonably require, we may not be able to provide you with the products or services you have requested, or otherwise deal with you effectively.

15. Accessing and correcting your personal information

(a) Subject to some exceptions provided by law, you may request access to the personal information we hold about you, and ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, please contact us using the details in section 20.

(b) We will respond to your request within a reasonable period. If we decline your request for access or correction, we will give you a written notice setting out our reasons, except where it would be unreasonable to do so.

16. Making a complaint

(a) If you have a concern or complaint about how we have handled your personal information, please contact us using the details in section 20. We will acknowledge your complaint and aim to respond within a reasonable period after we have had an opportunity to investigate.

(b) If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.

17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The current version will always be available on our website, and any changes take effect from the date the updated Privacy Policy is posted. We encourage you to review this Privacy Policy periodically.

18. Singapore - Personal Data Protection Act (PDPA)

This section applies to individuals in Singapore and to personal data handled by our Singapore entity. Where this section applies, “personal data” has the meaning given to it in the PDPA. In the event of any inconsistency between this section and the remainder of this Privacy Policy in respect of personal data governed by the PDPA, this section prevails.

18.2 Consent, notification and purpose

We collect, use and disclose your personal data for purposes that a reasonable person would consider appropriate in the circumstances and, where required, for which you have given (and not withdrawn) consent. We will notify you of the purposes for which your personal data will be collected, used or disclosed at or before the time of collection, or as otherwise permitted under the PDPA.

18.3 Access and correction

You may request access to the personal data we hold about you and information about the ways in which it may have been used or disclosed in the preceding year, and you may request that we correct an error or omission in your personal data. We will respond to your request as soon as reasonably possible, in accordance with the PDPA.

18.4 Withdrawal of consent

You may withdraw your consent to our collection, use or disclosure of your personal data at any time by giving us reasonable notice using the contact details below. On withdrawal, we will inform you of the likely consequences. Please note that withdrawing consent may mean we are unable to continue providing our products or services to you.

18.5 Protection, retention and transfer

We make reasonable security arrangements to protect personal data in our possession or control. We retain personal data only for as long as it is necessary for legal or business purposes. Where we transfer personal data outside Singapore, we take steps to ensure that the recipient provides a standard of protection comparable to that under the PDPA.

18.6 Data breach notification

Where a data breach involving your personal data is assessed as notifiable under the PDPA, we will notify the Personal Data Protection Commission (PDPC) and affected individuals in accordance with the PDPA.
